Upcoming TCEQ Stormwater Permit Expiration

The current TCEQ Stormwater Permit (Multi-Sector General Permit (MSGP), TXR05000090) expires August 14, 2021. You have 90 days following the effective date to submit an NOI or NEC to stay in compliance and obtain coverage under the new general permit.

What are some of the changes?

  • Applications (NOIs and NECs) were updated with additional information and must be submitted electronically
  • Signs or other notice of permit coverage must be posted in a location where it is safely and readily available for viewing at least five days from obtaining permit coverage
  • Delegation of Signatory forms must be submitted to TCEQ through STEERS
  • An updated SWP3 must be developed and implemented before submitting an NOI
  • Requirements of the General Location Map and Drainage Area Site Map were updated
  • SWP3’s list of spills and leaks were updated to include those “that could contribute pollutants to stormwater discharges”
  • Clarification was made that results of hazardous metals should be kept onsite, unless results exceed limits
  • SWP3s should now include narratives for the nature of adverse condition and rain gauge reading(s)
  • Sectors A, C, D, E, J, O, and S: modified tables for numeric effluent limitations based on federal effluent guidelines
  • Sectors E and J, O: revised the language to require the rain gauge to be located onsite
  • Facilities handling pre-production plastic must contain good housekeeping measures and BMPs to eliminate plastic in stormwater
