PHMSA Gas Gathering Rule

The Pipeline and Hazardous Materials Safety Administration (PHMSA) revised the Federal Pipeline Safety Regulations to improve the safety of onshore gas gathering pipelines. The final rule addresses Congressional mandates, Government Accountability Office recommendations, and public input received as part of the rule-making process. The amendments in this final rule extend reporting requirements to all gas gathering operators and apply a set of minimum safety requirements to certain gas gathering pipelines based on diameter and operating pressure. The rule does not affect offshore gas gathering pipelines.

Revisions

  • Requires documentation of the methodology utilized for determining the beginning and endpoints of each onshore gathering line, and line type (A, B, C, R)
  • Re-defines“incidental gathering” for new, replaced, relocated or otherwise changed gathering lines installed after May 16, 2022
  • Addition of two new types of regulated gathering lines (Type C and Type R)
  • Adds requirements for §192 compliance activities for Type C lines
  • MAOP determinations are required for certain gathering lines
  • Annual reporting required for all gathering lines, incident reporting required for specific line types, events, and timelines

Critical Timelines

  • Published November 2021
  • The rule goes into effect May 16, 2022
  • Type C lines existing on or before May 16, 2022 have one year to comply
  • Determination of line types and documentation of applicability / methodology for determining beginning and endpoints completed by November 16, 2022 (for existing lines) or before any new line goes into operation after May 16, 2022
  • The reporting deadline is March 15, 2023
