Upcoming ODEQ Stormwater Permit Expiration

The current ODEQ Stormwater Permit expires July 4, 2022. ODEQ published the updated OKR05 MSGP for public review on March 11, 2022. Upon issuance, facilities will have until July 2022 to update the SWP3, submit an NOI, and pay a fee to maintain coverage under the new MSGP.

What are the changes?

  • Signage must be posted at a safe, publicly accessible location close to the facility within 60 days of the OKR05 issuance with the OPDES permit/authorization number, a contact name and title, and a phone number.
  • Permittees must consider the risks and impacts to facilities by accounting for extreme flooding and discharges caused by major storm events.
  • The routine facility inspection now includes potential sources of pollution.
  • Auto-samplers or passive samplers can collect grab samples (but not recommended for quarterly visual monitoring). Samples must initiate within the first 30 minutes of a discharge.
  • Site visits are a requirement for new and renewal authorizations.
  • An SWP3 preparer must conduct a site visit within one year of construction completion.
  • Soil erosion areas and stormwater inlets are incorporated.
  • An annual SWP3 review with site map updates is required.
  • The permittee must give SWPP3 and associated records to anyone requesting it within seven days.
  • A summary description of any SWP3 modifications made during the annual reporting year will be part of the ACSCER.
