A waste minimization plan is a documented strategy for reducing the quantity and toxicity of waste generated by a facility. Large-quantity hazardous waste generators must certify on their waste manifests that they have a program to reduce waste volume and toxicity. While specific plan formats are not federally mandated, a documented program demonstrates good faith and is a best practice that also reduces disposal costs.
Hazardous waste is specifically defined under RCRA as waste that is listed as hazardous by EPA or exhibits one or more hazardous characteristics including ignitability, corrosivity, reactivity or toxicity. Non-hazardous waste does not meet these criteria but is still subject to state solid waste regulations governing disposal. Proper waste characterization is essential because the cost, liability and regulatory requirements for hazardous waste disposal are significantly greater than for non-hazardous waste.
The primary federal framework is RCRA (Resource Conservation and Recovery Act), implemented through EPA’s 40 CFR Parts 260 through 270 regulations. States have their own authorized hazardous waste programs that may be more stringent than federal rules. Oil and gas exploration and production wastes are often subject to state-specific regulations that differ from standard RCRA requirements.
